What types of documents do you need when planning for your loved one's future and the distribution of your property after you are gone? If you die without a will, the transfer of your assets will be governed by statute and the State of Maryland will impose its will for you.

It may be difficult for you to think about these things. Preparing these documents ahead of time is a gift you can give to your family, friends, loved ones, and doctors. This makes things easier for them because they won't have to guess what kind of treatment you want or don’t want.

Customized Estate Plans:

Each estate has its unique requirments and there are a variety of ways to set up an estate plan. I will review the pros and cons of the different options, draft the necessary documents and assist you in implementing your customized estate plan. During the process, we will go over questions such as:

  • Are there children involved?
  • Are there divorced spouses involved?
  • Are there special circumstances to consider such as blended families, adopted children, special needs or disabilities in the family?
  • Do you have special pets you would like to include in your will?
  • How large is the estate?
  • Is it a simple estate or complex estate?
  • Do you have any type of retirement accounts; such as a 401(k) plan, 403(b), IRA, or Roth IRA?
  • Do you own stocks or bonds?
  • Do you own property?
  • Would you or your family benefit from setting up a life estate deed?
  • What stage of life are you in?
  • How is your health?
  • Is estate planning becoming more important for you?
  • Would you like some of your money to go to charities?
  • If you own a business, do you have a succession plan?

 

Will Preparation and Filing of Wills:

New wills are prepared with your best interests in mind. From simple, small estates to large, complex estates, I can prepare a customized will to meet your specific needs.

As a service to the public, the Register of Wills for Carroll County accepts wills for safekeeping of living persons.  There is a nominal fee of $5 for each will placed with the Register of Wills for safekeeping.  A will held in safekeeping is usually placed in a box or vault by the Register of Will for protection.  This gives the maker of the will peace of mind that their will is safe.  You won’t have to worry about misplacing your will or it becoming lost or destroyed.  A will in safekeeping is not filed and therefore not public record until a person dies and their estate has been opened with the Register of Wills.  A will in safekeeping may be removed at any time by the maker in person.  There is a Register of Wills in every county and the City of Baltimore and each office provides this safekeeping service. 

Update Existing Wills:

There are many reasons for updating an existing will. Some of these may include changes in martial status, changes in beneficiaries, changes in asset distribution, planning for second marriages and non-joint children, planning for special needs children, planning for disabled family members, and other life changing events.

Living Wills / Healthcare Directives to Physicians and Families:

A healthcare directive will include a living will and appointment of primary and secondary health care agents for you. A living will addresses your feelings about life support in certain medical conditions. Health care agents will make health care decisions for you when you are unable to communicate for yourself and will look to your living will for direction from you on what you want done.
